What the Law Says
Section 194B MV Act: Whoever drives a motor vehicle or rides as a passenger in a front seat of a motor vehicle without wearing a seatbelt shall be punishable with a fine of ₹1,000. CMVR Rule 138 (as amended 2019): The driver must ensure that every occupant of the motor vehicle wears a seatbelt. Rear seat seatbelt mandate was affirmed in 2022 following the Tata Cymbal crash that killed Cyrus Mistry — prompting MoRTH to issue mandatory enforcement guidelines.
💡 Why This Rule Exists
A seatbelt is the single most effective safety device in a vehicle. In a 60 km/h crash, an unbelted occupant continues moving forward at 60 km/h until stopped by the dashboard or windshield. A seatbelt spreads this force across the chest and hips — the body's strongest load-bearing areas. Rear seat occupants without belts become projectiles that can kill the front-seat occupants even if they are belted.
