Complete Guide for Car Owners in India

Seatbelt laws, child seats, tint rules, parking, insurance, and maintenance — everything a car owner needs to know.

Cars are the fastest-growing vehicle category in India. Whether you own a hatchback or an SUV, these are the rules, checks, and safety practices every four-wheeler owner must follow.

Quick Facts

  • Seatbelt: all seats, ₹1,000 fine
  • Window tint: aftermarket films banned
  • Must carry: first aid kit, spare tyre
  • Tyre check: monthly pressure, 1.6 mm tread
  • PUC: every 6 months
  • Insurance: renew before expiry

Seatbelt Law

Section 194B MV Act: Every person in a motor vehicle must wear a seatbelt. This applies to both front and rear seat passengers.

  • Driver and front passenger: seatbelt mandatory. Penalty: ₹1,000.
  • Rear seat passengers: seatbelt mandatory (enforced from September 2022 notification).
  • Rear seat penalty: ₹1,000 on driver.
  • Seatbelt exemptions: reverse driving at slow speed, medical certificate holders (extremely rare).
  • Seatbelt must be a 3-point belt — lap-only belts in the centre rear are being phased out.

Child Safety — Car Seats and Restraints

India does not yet have a mandatory child car seat law at the central level, but the BIS has published IS 13468 (child restraint systems) and several states are moving toward mandatory enforcement.

  • Children under 12: should ride in the rear seat.
  • Rear-facing car seat: for infants up to 15 months / 13 kg.
  • Forward-facing car seat: for children 15 months to 4 years.
  • Booster seat: for children 4–12 years (until they are tall enough for the adult seatbelt to fit correctly).
  • Never hold a child on your lap in a moving car — in a collision at 50 km/h, a 10 kg child exerts 300 kg of force.
  • BIS standard: IS 13468 for child restraint systems.

Window Tint / Sun Film Rules

The Supreme Court of India banned all aftermarket window tinting in 2012.

  • Front windshield: minimum 70% Visual Light Transmission (VLT).
  • Front side windows: minimum 70% VLT.
  • Rear windows: minimum 50% VLT.
  • ALL aftermarket sun films are banned — even clear UV films.
  • Only factory-fitted tinted glass is permitted within VLT limits.
  • Penalty: ₹500–₹1,500. Police may remove the film on the spot.

Mandatory Equipment in Your Car

Every car should have (and some items are legally required):

  • First aid kit (CMVR Rule 116 — mandatory).
  • Warning triangles — 2 reflective triangles (mandatory for transport vehicles, recommended for all).
  • Spare tyre in serviceable condition.
  • Jack and wheel wrench.
  • Fire extinguisher (recommended — mandatory for transport vehicles).
  • Torch / flashlight.
  • Jumper cables.

Regular Maintenance Checks

These checks keep your car safe and legally compliant:

  • Engine oil: change every 10,000–15,000 km or annually.
  • Brake pads: check every 20,000 km — replace when worn to 2 mm.
  • Tyres: check tread depth (min 1.6 mm) and pressure monthly.
  • Coolant: check level monthly, flush every 2 years.
  • Battery: check terminals for corrosion, replace every 3–4 years.
  • Lights: check all headlights, tail lights, indicators, brake lights monthly.
  • Wipers: replace every year (crucial for monsoon).
  • Air filter: replace every 15,000–20,000 km.
  • PUC: renew every 6 months.
  • Insurance: renew annually — do not let it lapse.

Parking Rules

Where you cannot park:

  • On yellow kerb markings — no parking at any time.
  • Within 10 metres of an intersection.
  • Within 15 metres of a bus stop.
  • Within 6 metres of a fire hydrant.
  • Opposite another parked vehicle (double parking).
  • On footpaths or pedestrian areas.
  • In front of driveways or building entrances.
  • Hazard lights do NOT make illegal parking legal.
