Legal Source

MV Act Sec. 194E (inserted by MV Amendment Act 2019)

What the Law Says

Section 194E MV Act (added in 2019): No driver shall obstruct or fail to give way to an emergency vehicle — including police, ambulance, or fire service vehicle — when such vehicle is in the use of emergency duties and has its emergency lights and/or siren activated. The penalty for violation is ₹10,000. Courts have also found drivers liable under Sec. 304A IPC (culpable negligence) when delays caused by non-yielding contributed to a patient's death.

💡 Why This Rule Exists

Every minute of delay in reaching a hospital can make the difference between life and death for a heart attack, stroke, accident, or trauma patient. Studies show that Indian ambulances lose an average of several minutes to non-yielding traffic in urban areas. The 2019 amendment created a specific penalty for this after high-profile cases where ambulances were stuck in traffic while patients died inside.

Key Facts

  • 1

Move to the LEFT and slow down — do not accelerate ahead of the ambulance.

  • 2

At red lights: if an ambulance approaches with siren, you may proceed cautiously through the red to clear the intersection — this is legally protected.

  • 3

If you are on a narrow road, pull as far left as possible even if you must stop on the shoulder.

  • 4

Emergency vehicle includes: ambulance, fire engine, police vehicle with siren, and disaster response vehicles.

  • 5

The ₹10,000 penalty was specifically introduced in the 2019 amendment to address India's severe ambulance obstruction problem.

⚠️ Common Violations

  • Continuing at normal speed ahead of an ambulance to avoid slowing down.

  • All vehicles in a traffic jam remaining stationary rather than pulling left.

  • Not recognising the obligation extends to police vehicles responding to emergencies.

  • Blocking the ambulance at a red light when there is space to move forward and clear the path.
