MV Act Sec. 128, 129, 194D; CMVR Rule 138

What the Law Says

Section 128 MV Act: A two-wheeled motorcycle shall not carry more than one person in addition to the driver. Section 129: Every person driving or riding on a motorcycle shall wear a protective headgear (helmet) conforming to BIS standards. CMVR Rule 138: The pillion seat must be properly fixed, with footrests on both sides.

💡 Why This Rule Exists

Triple riding (three on a two-wheeler) shifts the centre of gravity, reduces braking effectiveness, and impairs the rider's ability to balance — especially at turns. Two-wheeler fatalities constitute roughly 45% of all road deaths in India, and many involve unhelmeted pillion riders.
