Power of Central Government to make rules.—(1) The Central Government may make rules for the purpose of carrying into effect the provisions of this Chapter, other than the matters specified in section 159.

(P) In section 164, after sub-section (3), the following sub-section and Explanation shall be inserted, namely:— ‘(4) Notwithstanding anything contained in sub-section (3), ex gratia payments received in respect of death or grievous hurt due to an accident arising out of the use of motor vehicle, shall not be liable to be reduced from the amount of compensation payable under this section. Explanation.—For the purposes of section 163 and this section, the expression “grievous hurt” shall be as referred to in section 116 of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023).’.
Amending instruction from the Jan Vishwas (Amendment of Provisions) Act, 2026 (No. 8 of 2026), Schedule entry 51, quoted verbatim. It took effect for the Motor Vehicles Act on 15 August 2026 under S.O. 4100(E), 24 July 2026. Where it conflicts with the text above, this later change prevails.
