Motor Accident Claims — How to Get Compensation

If you or a family member is injured in a road accident, you are entitled to compensation. Here's how to claim it.

Every road accident victim in India — whether driver, passenger, pedestrian, or cyclist — is entitled to compensation. Claims are filed through the Motor Accident Claims Tribunal (MACT). The process is designed to be accessible, but knowing the steps helps you get fair compensation faster.

Quick Facts

  • File at MACT: no court fee
  • Time limit: 6 months (extendable)
  • Hit-and-run: ₹2,00,000 from govt fund
  • Compensation: medical + income + suffering
  • Interim payment: available during the case
  • Interest: 7–9% from date of filing

Who Can File a Claim?

The following persons can file a motor accident claim:

  • The injured person themselves.
  • Legal heirs of a person who died in the accident.
  • Parents or guardians on behalf of a minor.
  • A lawyer or authorized representative.
  • In hit-and-run cases: the claim is filed against the Motor Accident Fund (government fund).

Where to File

Claims are filed at the Motor Accident Claims Tribunal (MACT):

  • MACT courts exist in every district.
  • File in the district where the accident occurred OR where the claimant resides.
  • No court fee is required to file an MACT claim.
  • You can file without a lawyer, but having one is strongly recommended.
  • Time limit: file within 6 months of the accident (extensions are granted liberally).

What You Need to File

Documents required for filing a claim:

  • FIR copy and police investigation report.
  • Medical records: hospital bills, discharge summary, doctor's reports.
  • Proof of income: salary slips, IT returns, business records (for calculating compensation).
  • Death certificate (in fatal accident cases).
  • Vehicle registration and insurance details of the offending vehicle.
  • Witness statements (if available).
  • Photos of the accident scene and injuries.

Types of Compensation

MACT awards compensation for:

  • Medical expenses: past, present, and future treatment costs.
  • Loss of income: during recovery and permanent loss of earning capacity.
  • Pain and suffering: a lump sum for physical and mental anguish.
  • Loss of consortium: for the spouse of a permanently injured person.
  • Funeral expenses: in death cases.
  • Loss of dependency: in death cases — calculated based on the deceased's income, age, and number of dependents.
  • Multiplier method: annual loss × multiplier (based on age of deceased). Supreme Court has set standardized multipliers.

Hit-and-Run Claims

If the offending vehicle fled and cannot be identified:

  • Claims are paid from the Motor Vehicle Accident Fund (Sec. 161, 163 MV Act).
  • Death: ₹2,00,000 compensation (2019 amendment — may be revised upward).
  • Grievous hurt: ₹50,000.
  • File: at the nearest MACT court or through the Claims Settlement Commissioner.
  • No need to identify the vehicle — an FIR recording the hit-and-run is sufficient.

Timeline

The MACT process takes time but provides just compensation:

  • Filing to first hearing: 1–2 months.
  • Evidence and arguments: 6–18 months.
  • Award: 1–3 years from filing (varies by court backlog).
  • Insurance company pays within 30 days of award (if not appealed).
  • Interim compensation: MACT can order interim payment during the case.
  • Interest: MACT awards interest (typically 7–9%) from the date of filing to the date of payment.
